Nechalos Chapter 1: Laws of Inheritance

Overview

This chapter explains the Torah’s system of inheritance: who inherits first, the priority between male and female heirs, and how inheritance proceeds through generations. It also addresses special cases such as family relationships, illegitimate children, and the husband’s rights to his wife’s property.

Halacha 1 – Basic Order

When a person dies, sons inherit first, and among children, males precede females.

Halacha 2 – No Joint Inheritance

A daughter does not inherit alongside a son. If there are no children, the father inherits. The mother never inherits her children—this is a received tradition.

Halacha 3 – Chain of Succession

Inheritance follows this order:

  1. Sons → their descendants (male or female, indefinitely).
  2. If no son or descendants, then daughters → their descendants.
  3. If none, inheritance goes to the father → his descendants (brothers, sisters, etc.).
  4. If none, inheritance moves upward to grandfather and his descendants. Rule: Male relatives precede females, and descendants of males precede descendants of females. This process continues up the family tree until a relative is found.

Halacha 4 – Priority of Descendants

A granddaughter (through a son) precedes a daughter. Similarly, a niece through a brother precedes a sister, and so on.

Halacha 5 – Division Among Branches

If two sons die before their father, leaving children, each branch inherits its father’s share. This applies through all generations.

Halacha 6 – Maternal Family Excluded

Inheritance is only through the father’s family. Maternal relatives do not inherit. Brothers from the same mother do not inherit each other; brothers from the same father do.

Halacha 7 – Illegitimate Children

Relatives who are disqualified for marriage (e.g., a mamzer) still inherit like any other child or sibling. But a child from a maidservant or non-Jewish woman is not considered a son and does not inherit.

Halacha 8 – Husband and Wife

A wife does not inherit her husband at all. A husband inherits all his wife’s property by rabbinic law and precedes all others—even if the marriage was forbidden or if he is deaf.

Halacha 9 – Conditions for Husband’s Inheritance

The husband inherits only if the wife entered his domain (full marriage). He does not inherit if she was divorced (even doubtful divorce). He inherits property she already possessed, not property that would come to her after death.

Halacha 10 – Invalid Marriages

If the husband married a minor who requires refusal (mi’un) or a mentally incompetent woman, he does not inherit her.

Halacha 11 – Property After Wife’s Death

If the wife dies and later her father or other relatives die, the husband does not inherit those later properties. They go to her descendants or her father’s family.

Halacha 12 – Husband’s Heirs Do Not Inherit Wife

If the husband dies first, his heirs do not inherit the wife when she dies later. Her inheritance goes to her father’s family.

Halacha 13 – Son Does Not Inherit Mother Posthumously

If a son dies before his mother, his heirs do not inherit her. If the mother dies first and then the son—even for a moment—the son inherits and passes it to his heirs.
